PARTICIPANT INFORMED CONSENT AND ASSUMPTION OF RISK AGREEMENT

1. Agreement to Participate
This is a binding legal agreement. Please ask any questions before signing. As participants in circus training, performances, classes, camps, workshops, and related programs or services offered by Capital Circus (the “Activities”), the undersigned Participant (and Parent/Guardian if under 18) (collectively, the “Parties”) acknowledge and agree to the terms below.
2. Capital Circus and Representatives
For the purpose of this Agreement, “Organization” refers to Capital Circus and its directors, officers, coaches, staff, volunteers, agents, facility owners/operators, sponsors, and representatives.
3. Description and Acknowledgement of Risks
The Parties understand and acknowledge that:
The Activities involve foreseeable and unforeseeable risks, hazards, and dangers that no amount of care, caution, or expertise can completely eliminate.
While Capital Circus takes steps to promote safety, it is not possible to guarantee a risk-free environment.
Circus activities may include the use of specialized equipment, instruction, and physical challenges that involve risk of injury.
The risks include, but are not limited to:
Physical exertion such as stretching, balancing, tumbling, climbing, aerial work, or juggling.
Strains, sprains, fractures, concussions, or other injuries to muscles, joints, ligaments, bones, or the body in general.
Falling from apparatus or colliding with mats, floors, walls, equipment, or other participants.
Equipment malfunction or improper use of equipment.
Contact with other participants, staff, or spotters.
Emotional stress, anxiety, or fatigue from physical challenge.
Illness or contracting contagious diseases including COVID-19.
Travel to and from events or performances related to the Activities.
4. Participation Terms
By taking part in the Activities, the Parties agree that:
Participation is voluntary, and the Participant accepts the risks involved.
The Participant’s physical and mental condition is appropriate for participation.
All rules, instructions, and facility guidelines will be followed.
The Participant will not participate if impaired in any way.
When practicing or training outside Capital Circus facilities, the Participant (and Parent/Guardian, if applicable) is responsible for ensuring a safe environment.
5. Release of Liability and Indemnity
In consideration of being allowed to participate in the Activities, the Parties agree:
That they are not relying on any verbal or written statements outside of this Agreement to take part in the Activities.
That participation is at the Participant’s own risk. The Parties release and discharge Capital Circus and its representatives from any and all responsibility for injury, loss, or damage connected to participation in the Activities, to the fullest extent permitted by law.
That Capital Circus and its representatives are not responsible for any loss or damage to personal property, vehicles, or equipment.
To indemnify and hold harmless Capital Circus and its representatives from any claims or demands arising out of participation in the Activities.
That this Agreement is intended to be as broad and inclusive as permitted under Ontario law, and if any part is held invalid, the remainder shall continue in full force.
6. Jurisdiction
The Parties agree that any legal matters relating to this Agreement shall be dealt with solely in the Province of Ontario.
7. Acknowledgement
The Parties confirm that they have read this Agreement, understand it, and sign it voluntarily. This Agreement is binding upon the Participant, their parents/guardians, heirs, next of kin, executors, administrators, and legal representatives.
8. Privacy & Signature
Capital Circus may collect limited electronic information when this Agreement is signed electronically. This information will only be used to verify the Agreement and will not be shared, sold, or used for other purposes.
By typing or signing my name below, I agree that this electronic signature has the same legal force and effect as a handwritten signature.
